've declined to sign...
CanWest MediaWorks require freelance writers and photographers across Canada who want to work for them, or continue working for them to sign their Freelance Writer Agreement. The problem is that signing this agreement (contract) is akin to committing professional suicide.
The contract is below but here are some highlights as to whyu this document is impossible to sign.
The contract:
- Seizes a Freelance writer or photographer's copyright forever for the company's dirverse use throughout all media
- Forces Freelancers to forgo compensation from placement of their work throughout digital or optical media, i.e. for electronic use.
- Demands Moral Rights which under copyright law are not assignable, (Moral Rights refer to the integrity of a creator's work and their right to have the work attributed to them or to publish annoymously or psudonymously).
- Refuses to pay Freelancers royalties or residuals so no compensation is reveived for reprint rights.
- Indemnifies CanWest, in this case, the Ottawa Citizen, from damages or liabilities which were hitherto the responsibility of the paper.
- Prevents a Freelancer from choosing if they want their work to be "syndicated in Commerical Use" to third parties.
